Hillary Collins Shareholder at Rees Broome, PC. Hillary represents homeowners’ and condominium associations throughout D.C., Maryland and Northern Virginia. Her practice focuses on assisting associations with revisions to governing documents, the enforcement of covenants and with collection efforts in D.C., Maryland and Virginia. Hillary also specializes in transitions to association control from the developer and common element warranty claims. Hillary works with associations to: Overhaul and revise outdated governing documents to incorporate newly adopted provisions of law and to delete obsolete provisions pertaining to declarant rights and obligations; Implement new strategies and policies to maximize collection efforts in a challenging economy; Review and revise contractual agreements; Resolve homeowner disputes; Draft policy resolutions to address the unique and often complicated circumstances faced by associations in the areas of due process, architectural control, design guidelines, Fair Housing accommodations, and insurance deductible responsibility; Manage insurance losses; Navigate claims against the developer during transition; and Assist Boards with claims against homeowners for violations of the governing documents. Prior to joining Rees Broome, PC, Hillary handled complex litigation matters in Virginia, Maryland and Washington, DC. This litigation experience has enabled Hillary to better advise clients on issues relating to the governance of associations and the enforcement of associations’ governing documents. In one case, a client avoided economic collapse by adopting a policy resolution to address the limitation of liability clause in its governing documents. This allowed the client to avoid additional liability for water damage claims in an association that suffered repeated sewage back-ups. Hillary has also assisted clients in navigating contested covenant enforcement matters.
